Clement, who's on the board of the energy concern RWE Power AG, had recommended indirectly that voters avoid the Hesse SPD's top candidate Andrea Ypsilanti because of her energy policies. His lawyer said Clement would reply this weekend. Clement can still lodge an appeal internally within the SPD. In 1998 Clement became premier of North Rhine-Westphalia before shifting in 2002 to the government of ex-chancellor Gerhard Schroeder.
